Acceptance of Terms
By accessing or using DecisionLog, you agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use our Service.
Description of Service
DecisionLog is a platform for tracking and managing decisions similar to Architecture Decision Records (ADRs). The Service allows you to document decisions, organize them into collections, and maintain a history of your decision-making process.
User Accounts
To use certain features of our Service, you must register for an account. You agree to:
- Provide accurate and complete information
- Keep your account credentials secure
- Be responsible for all activity under your account
- Notify us immediately of any unauthorized use
Acceptable Use
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to the Service
- Transmit viruses, malware, or other harmful code
- Violate any applicable laws or regulations
- Abuse, harass, or harm other users
User Content
You retain ownership of any content you create or upload to the Service ("User Content"). However, you grant us a license to use, store, and display your User Content as necessary to provide the Service.
You are solely responsible for your User Content and must ensure it does not violate any laws or third-party rights.
Intellectual Property
The Service and its original content, features, and functionality are owned by DecisionLog and are protected by international copyright and other intellectual property laws.
Fees and Payment
7.1 Current Free Service
DecisionLog is currently offered as a free service. You are not required to pay any fees to use the Service at this time.
7.2 Future Service Changes
We reserve the right to introduce changes to the free plan, including the possibility of introducing paid features, premium tiers, or subscription plans in the future. Changes may affect the availability of some features in the free plan.
7.3 No Obligation
You have no obligation to purchase any paid features. You may continue using the free version or cancel your account at any time.
Data Storage and Availability
8.1 Data Loss Disclaimer
IMPORTANT - PLEASE READ CAREFULLY:
While we implement industry-standard practices, WE DO NOT GUARANTEE the availability, integrity, or permanence of your data. Your data may be lost, corrupted, or become unavailable including but not limited to due to:
- Database failures or corruption
- Third-party infrastructure outages (Render.com, PostgreSQL)
- Software bugs or errors in our code
- Cyber attacks, security breaches, or unauthorized access
- Hardware failures or data center incidents
- Human error or operational mistakes
- Force majeure events (see Section 10)
- Service discontinuation
- Any other circumstances beyond our control
YOU EXPRESSLY ACKNOWLEDGE AND AGREE that DecisionLog is NOT a backup service and should NOT be your only copy of important information.
8.2 No Backup Service
We do NOT provide automated backup or data recovery services:
- We do not guarantee the ability to restore lost or corrupted data
- We do not maintain redundant copies of your data for recovery purposes
- In the event of data loss, we cannot and will not restore your data
- Database backups (if any) are for disaster recovery of our infrastructure, not for individual user data recovery
YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE for maintaining independent backups of any critical data stored in DecisionLog.
8.3 Export and Backup Responsibility
We strongly recommend:
- Regularly exporting your data using the export feature
- Maintaining local copies of important decisions and collections
- Not relying on DecisionLog as your primary or only storage location
- Treating DecisionLog as a collaboration and organization tool, not an archival system
8.4 Export Limitations
Data export is provided "as-is" without guarantees:
- We do not guarantee export completeness or accuracy
- Export formats may change without notice
- Export functionality may be unavailable during outages
- Exported data may not be compatible with other systems
8.5 No Liability for Data Loss
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DecisionLog shall have ZERO LIABILITY for any data loss, regardless of cause, including but not limited to:
- Loss of decisions, collections, templates, or other content
- Loss of access to your data
- Corruption or modification of your data
- Inability to export or recover your data
This disclaimer applies even if we were advised of the possibility of such loss.
Third-Party Service Dependencies
9.1 Service Dependencies
DecisionLog relies on third-party services to function, including but not limited to:
- Auth0 (USA): User authentication and account management
- Render.com (USA): Application hosting and database infrastructure
- PostgreSQL: Database system (hosted on Render)
- Cloudinary (USA): Image hosting and processing
- Google Analytics (USA): Analytics (optional)
- Firebase Analytics/Crashlytics (USA): Mobile app analytics and crash reporting (optional)
- MailerLite (EU): Email marketing and newsletters (optional)
9.2 No Control Over Third-Party Services
We do NOT control these third-party services and are NOT responsible for:
- Their availability, performance, or reliability
- Their security practices or data breaches
- Changes to their terms of service or pricing
- Their discontinuation or termination
- Any damages resulting from their failures or issues
9.3 Service Availability Impact
If any third-party service fails or becomes unavailable:
- DecisionLog may become partially or completely unavailable
- Features may be degraded or non-functional
- Data may become temporarily or permanently inaccessible
- We may need to find alternative service providers (causing potential disruption)
9.4 No Liability for Third-Party Failures
YOU EXPRESSLY ACKNOWLEDGE AND AGREE that DecisionLog shall have NO LIABILITY for any damages, losses, or inconveniences resulting from:
- Unavailability of third-party services
- Data breaches at third-party providers
- Changes to third-party terms, pricing, or functionality
- Discontinuation of any third-party service
- Performance issues with third-party services
- Any other third-party service failures or issues
9.5 No Service Level Agreements (SLA)
We do NOT have service level agreements with most third-party providers. We cannot guarantee their performance, uptime, or support response times.
Force Majeure
10.1 Force Majeure Events
DecisionLog shall NOT be liable for any failure or delay in performance INCLUDING BUT NOT LIMITED TO causes beyond our reasonable control:
Natural Events:
- Natural disasters (earthquakes, floods, hurricanes, etc.)
- Epidemics, pandemics, or public health emergencies
- Severe weather conditions
Human Actions:
- War, terrorism, civil unrest, riots
- Government actions, embargoes, sanctions
- Strikes, labor disputes, lockouts
Technical Events:
- Internet or telecommunications failures
- Power outages or electrical grid failures
- Data center failures or incidents
- Cloud provider outages (AWS, GCP, etc.)
- DNS or routing failures
Cyber Events:
- Cyber attacks, DDoS attacks, ransomware
- Hacking attempts or security incidents
- Malware or virus infections
Third-Party Events:
- Supplier or vendor failures
- Third-party service outages (Auth0, Render, Cloudinary, etc.)
- Payment processor failures
10.2 Suspension of Obligations
During a force majeure event:
- Our obligations under these Terms shall be suspended for the duration of the event
- We will make reasonable efforts to mitigate the impact and resume normal operations
- We will notify you of the force majeure event if reasonably possible
10.3 Extended Force Majeure
If a force majeure event continues for more than 30 consecutive days:
- Either party may terminate these Terms without liability
- You may request account deletion and data export (if technically feasible)
10.4 No Compensation
You agree that you will NOT be entitled to any compensation, damages, or remedies for service interruptions or unavailability caused by force majeure events.
Beta and Experimental Features
11.1 Beta Features
DecisionLog may offer beta, experimental, or early-access features ("Beta Features") from time to time. Beta Features are provided "AS-IS" with ABSOLUTELY NO WARRANTIES.
11.2 Risks of Beta Features
Beta Features may:
- Contain bugs, errors, or defects
- Cause data loss, corruption, or unavailability
- Be incomplete, unstable, or not function as intended
- Have security vulnerabilities
- Crash, freeze, or behave unpredictably
- Be modified, disabled, or removed at any time without notice
- Not be supported or documented
11.3 Use at Your Own Risk
BY USING BETA FEATURES, YOU ACKNOWLEDGE AND AGREE THAT:
- You use Beta Features entirely at your own risk
- DecisionLog has ZERO LIABILITY for any issues caused by Beta Features
- We are not obligated to fix bugs or provide support for Beta Features
- Beta Features may never be released as stable features
- Data created with Beta Features may be lost or become incompatible
11.4 No Service Level Guarantees
Beta Features are EXCLUDED from any service level agreements, warranties, uptime guarantees, or support commitments (even if such commitments exist for stable features).
11.5 Feedback License
If you provide feedback about Beta Features, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate your feedback without compensation or attribution.
Service Availability
12.1 No Uptime Guarantee
DecisionLog is provided on an "as available" basis. WE DO NOT GUARANTEE any specific uptime, availability, or performance levels.
The Service may experience:
- Scheduled maintenance windows (with or without advance notice)
- Unscheduled downtime due to technical issues
- Performance degradation during peak usage
- Temporary or permanent service interruptions
- Complete service discontinuation
12.2 Maintenance and Updates
We reserve the right to:
- Perform maintenance at any time (including during business hours)
- Update, modify, or change the Service without notice
- Temporarily suspend the Service for upgrades or repairs
- Not provide advance warning of maintenance (though we will try when feasible)
12.3 No Compensation for Downtime
YOU EXPRESSLY AGREE that DecisionLog shall NOT be liable for any damages, losses, or compensation claims resulting from service downtime, whether:
- Planned or unplanned
- Short-term or long-term
- Partial or complete
- With or without data loss
This includes loss of productivity, business opportunity, revenue, or any other consequential damages.
Account Suspension and Termination
13.1 Termination by User
You may terminate your account at any time by:
- Using the account deletion feature in your account settings
- Contacting us at contact@decisionlog.me
Upon termination:
- Your data will enter a 90-day retention period (see Privacy Policy Section 7.2)
- You will no longer have access to the Service
- You should export any data you wish to retain before deletion
13.2 Termination by DecisionLog
We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to:
Violations:
- Breach of these Terms or our Privacy Policy
- Violation of applicable laws or regulations
- Fraudulent, abusive, or illegal activity
- Impersonation or misrepresentation
Technical Reasons:
- Excessive resource use that affects Service performance
- Automated scraping or API abuse
- Attempts to hack, exploit, or bypass security measures
- Uploading malware, viruses, or harmful code
Business Reasons:
- Non-payment of fees (if paid features introduced)
- Chargebacks or payment disputes
- Service discontinuation (see Section 13.4)
Inactivity:
- Accounts inactive for more than 2 years may be automatically deleted
13.3 Effect of Termination
Upon termination (by either party):
- Your access to the Service will be immediately revoked
- Your data will enter the retention period specified in our Privacy Policy
- All licenses granted to you under these Terms will terminate
- Sections that by their nature should survive (e.g., liability limitations, warranties disclaimers) will continue to apply
13.4 Service Discontinuation
We reserve the right to discontinue DecisionLog entirely at any time, with or without notice. If we discontinue the Service:
- We will make reasonable efforts to provide advance notice (e.g., 30 days) if feasible
- You will have the opportunity to export your data (if technically feasible)
- We are not obligated to provide refunds, compensation, or migration assistance
- All Terms and warranties will terminate
13.5 No Obligation to Retain Data
After the retention period expires (see Privacy Policy Section 7), we have NO OBLIGATION to retain or provide your data, even if you request it.
13.6 Survival
The following sections survive termination: Intellectual Property, Data Loss Disclaimer, Third-Party Dependencies, Limitation of Liability, Disclaimer of Warranties, Governing Law, and any other provisions that by their nature should survive.
Governing Law and Jurisdiction
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.
15.2 Jurisdiction
Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Poland.
15.3 EU Consumer Rights
If you are a consumer residing in the European Union, nothing in these Terms affects your statutory consumer rights, including the right to bring proceedings before the courts of your country of residence.
15.4 Language
These Terms are provided in English and Polish. In case of any discrepancy between the language versions, the Polish version shall prevail for purposes of legal interpretation.
Changes to Terms
21.1 Right to Modify
We reserve the right to modify, update, or replace these Terms at any time, in our sole discretion, for any reason.
21.2 Notification of Material Changes
If we make material changes to these Terms:
- We will update the "Last updated" date at the top of this page
- We will notify you by email (if you have provided one)
- We will post a notice on our Service for at least 30 days
- In some cases, we may require you to accept the new Terms to continue using the Service
21.3 Effective Date
Changes become effective:
- Immediately upon posting for non-material changes
- 30 days after notification for material changes
- Upon your acceptance, if we require explicit acceptance
21.4 Continued Use Constitutes Acceptance
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you should:
- Stop using the Service immediately
- Delete your account
- Export any data you wish to retain
21.5 Review Regularly
We encourage you to review these Terms periodically to stay informed about your rights and obligations.
Entire Agreement
22.1 Complete Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and DecisionLog regarding the Service and supersede all prior agreements, understandings, representations, and warranties, whether written or oral.
22.2 No Reliance
You acknowledge that you have not relied on any statement, representation, or warranty made by DecisionLog that is not expressly set forth in these Terms or our Privacy Policy.
22.3 No Modifications Except in Writing
No modification, amendment, or waiver of any provision of these Terms shall be effective unless in writing and signed by an authorized representative of DecisionLog.
